Consideration of Consequences and Related Legal Maxims in Mālikī Jurisprudence

This study examines how Mālikī jurists integrate consideration of consequences (maʾālāt) into legal reasoning. It defines core terms and links outcomes to the objectives of the Sharīʿah (maqāṣid), showing how means and ends interact in rulings. Drawing evidence from the Qurʾān, Sunnah, analogy (qiyās), and the Companions’ consensus, it maps key legal maxims such as sadd al-dharāʾiʿ and maṣlaḥah mursalah. It then illustrates jurisprudential applications across worship, transactions, criminal law, governance, and social ethics.
